Cofinda Pilot Terms

These Pilot Terms are an agreement between you and Darren Hogan, trading as Cofinda ("Cofinda", "we", "us"). They apply whenever you use the Cofinda pilot. By creating an account, or by accepting these terms when asked in the app, you confirm that you are 18 or over and that you agree to these terms. If you do not agree, you must not use Cofinda.

1. About the pilot

Cofinda is an early pilot service that lets collectors record the football stickers they own, see which stickers they are missing, and find other collectors with whom a reciprocal swap is possible. Places in the pilot are limited and registration may be closed at any time once the cap is reached.

Because this is a pilot, features may change, be paused or be withdrawn, and the service may be unavailable at times. We may end the pilot altogether on reasonable notice.

2. Eligibility

You must be 18 or over and resident in the United Kingdom to take part. You must register with accurate information, keep your account details up to date, and provide a genuine delivery address that can receive post. You are responsible for everything done through your account and for keeping your password secure. An adult may use their account to manage a child's collection and swaps on the child's behalf, but the adult remains the account holder and is responsible for all activity on the account.

3. Cofinda's role in swaps

Swaps are agreements between collectors. Cofinda provides the matching and tracking tools only. We are not a party to any swap, we do not own, hold, inspect, insure or post any stickers, and we do not act as agent, escrow or broker for either collector.

Any dispute about a swap is between the collectors involved. We may record trade outcomes, adjust trust scores and, at our discretion, suspend accounts, but we are not obliged to resolve disputes or to compensate either collector.

4. Your obligations when swapping

  • Keep your recorded collection accurate. Only offer duplicate stickers you actually hold and are willing to send.
  • Once you accept a trade, post the agreed stickers promptly and mark your package as posted only when you have genuinely sent it. Marking a package as posted reduces your saved quantities and cannot be undone.
  • Package stickers so they arrive undamaged, and pay your own postage costs.
  • Verify receipt honestly, reporting stickers as received, missing, incorrect or damaged according to what actually arrived.
  • Use another collector's delivery address only to post their stickers for that trade, and never for marketing, contact outside Cofinda or any other purpose.
  • Do not sell, buy or offer money or other consideration for stickers through Cofinda. Swaps do not have to be equal in number — you and another collector may agree an uneven exchange of stickers — but the pilot is for swapping stickers only, never for buying or selling them.

5. Acceptable use

You must not:

  • create more than one account for yourself, or register on behalf of another adult. An adult may hold an account to manage a child's collection, provided the adult accepts these terms, controls the account and is responsible for everything done through it;
  • misrepresent your collection, manipulate trust scores, or make proposals you do not intend to honour;
  • harass, threaten, defraud or abuse other collectors, or contact them for purposes unrelated to a trade;
  • upload unlawful, offensive or infringing content, including in display names;
  • attempt to access other users' data, probe or interfere with the service, scrape it at scale, or use it through automated means without our permission.

6. Suspension and termination

We may suspend or close your account if we reasonably believe you have broken these terms, put other collectors at risk, or misused the service. If your account is suspended, your collection and trade history are preserved but you cannot use Cofinda, and trades involving you are frozen. You can close your account at any time by contacting us, and we will handle your data as set out in the Privacy Notice.

7. Content and intellectual property

Cofinda, its software, design and content are owned by Darren Hogan or licensed to him. You may use them only to take part in the pilot. Sticker names, numbers, images and trade marks belong to their respective owners; Cofinda is not affiliated with, endorsed by or sponsored by any sticker publisher, club, league or federation. You keep ownership of the content you enter and grant us a licence to use it as needed to operate the service.

8. Availability and no warranty

The pilot is provided free of charge and "as is". We do not guarantee that the service will be uninterrupted, error-free or secure, that matches will be found, or that data you enter will always be preserved. Please keep your own record of anything important to you.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

Cofinda is not responsible for losses caused solely by another collector, postal or delivery services, or circumstances outside our reasonable control. This does not exclude or limit any responsibility Cofinda has where loss is caused by our own failure to provide the service with reasonable care and skill or where liability cannot lawfully be excluded.

If you are a consumer, your statutory rights are unaffected by these terms.

10. Privacy

We use your personal information as described in the Privacy Notice, which explains what we collect, how it is used, and the rights you have. Taking part in a trade means sharing your delivery address with that trading counterparty.

11. Changes to these terms

We may update these terms as the pilot develops. Each version has a date, and when we publish a new version we will ask you to accept it in the app before you continue using Cofinda. If you do not accept the current version, you will not be able to use the service.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
